COMPACT TERMS OF USE

By creating an account or using the Buy N Go Pickup and Delivery Services LLC (hereinafter referred to as “Buy N Go Pickup”) mobile application or website (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by Buy N Go Pickup's Terms and Conditions and Privacy Policy (collectively, the "Agreement"), which govern your use of the Platform, including any transactions, interactions with drivers or customers, and use of third-party services.

1. ACCEPTANCE OF TERMS

1.1 By accessing or using the Platform, you expressly agree to:

1.1.1 Comply with all applicable laws and regulations;

1.1.2 Provide accurate information for account creation; and

1.1.3 Accept all rights, obligations, and limitations set forth in the Agreement.

1.2 If you do not agree to these terms, you must not create an account or use the Platform.

1.3 Buy N Go Pickup reserves the right to modify these terms at any time without prior notice. Your continued use of the Platform following any modifications constitutes your acceptance of the revised terms.

1.4 You acknowledge that these terms may be updated from time to time, and it is your responsibility to review them regularly.

2. USER ACCOUNTS

2.1 Account Security and Responsibility

2.2 Users must maintain a secure account and keep login credentials confidential.

2.3 Users are responsible for all activity conducted under their account, including any transactions initiated through the account.

2.4 Unauthorized access due to failure to secure credentials is solely the responsibility of the User.

2.5 You must immediately notify Buy N Go Pickup of any unauthorized use of your account or any other security breach.

2.6 Buy N Go Pickup reserves the right to suspend or terminate your account if we suspect unauthorized or fraudulent activity.

2.7 Account Information

2.8 You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

2.9 Failure to provide accurate information may result in immediate termination of your account.

3. PAYMENTS AND THIRD-PARTY VENDORS

3.1 Payment Processing

3.2 All payments are processed via third-party payment processors, including Stripe.

3.3 You agree to comply with all terms and conditions of the third-party payment processors.

3.4 Buy N Go Pickup is not responsible for any fees, charges, or terms imposed by third-party payment processors.

3.5 Data Sharing and Consent

3.6 Users expressly consent to data sharing with third-party vendors for purposes including but not limited to background verification, insurance validation, and payment processing.

3.7 Buy N Go Pickup will only share data necessary for the provision of services and in compliance with our Privacy Policy.

3.8 Limitation of Liability for Third-Party Services

3.9 Buy N Go Pickup is not liable for errors, delays, or acts of third-party vendors.

3.10 Buy N Go Pickup makes no warranties or representations regarding the quality, accuracy, reliability, or suitability of any third-party services.

4. USE OF THE PLATFORM

4.1 Service Description

4.2 The Platform provides on-demand pickup and delivery services for bulky items. Buy N Go Pickup does not provide transportation services itself but facilitates connections between users and independent service providers.

4.3 Buy N Go Pickup does not guarantee the availability of service providers at all times or in all locations.

4.4 User Compliance

4.5 Users must comply with all applicable laws, rules, and restrictions regarding the goods being transported.

4.6 Users warrant that they have legal ownership or authorization to transport all items submitted through the Platform.

4.7 Drivers are solely responsible for ensuring that all items are properly packaged, secured, and protected to prevent loss, damage, or deterioration during transport. The Company shall not be liable for any damage resulting from improper packaging, handling, or loading by the driver.

4.8 Prohibited Items and Activities

4.9 Prohibited use includes transporting illegal, hazardous, or unsafe items, including but not limited to:

4.10 Controlled substances, illegal drugs, or drug paraphernalia

4.11 Weapons, ammunition, or explosives

4.12 Hazardous materials or toxic substances

4.13 Stolen goods or contraband

4.14 Human remains or body parts

4.15 Live animals

4.16 Perishable goods requiring refrigeration

4.17 Items exceeding weight or size limitations as specified on the Platform

4.18 Buy N Go Pickup reserves the right to refuse service for any item at its sole discretion.

4.19 Users agree not to use the Platform for any illegal, harmful, fraudulent, or abusive purpose.

5. LIABILITY, INDEMNIFICATION, AND ARBITRATION

5.1 Indemnification:

5.1.1.Users agree to defend, indemnify, and hold harmless Buy N Go Pickup, its affiliates, officers, directors, employees, agents, and service providers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

5.1.1.1 Your use of the Platform

5.1.1.2 Your violation of these Terms or any applicable law

5.1.1.3 Your violation of any third-party rights

5.1.1.4 Any content or items you submit through the Platform

5.1.1.5 Any interaction with service providers or other users

5.1.2 Dispute Resolution:

5.1.2.1 Users waive any right to jury trial or class action and agree to binding arbitration for disputes.

5.1.2.2. Any dispute arising from or relating to these Terms or the Platform shall be resolved exclusively through final and binding arbitration in the State of Florida.

5.1.2.3 The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association.

5.1.2.4 Notwithstanding the foregoing, Buy N Go Pickup may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

5.1.3 Limitation of Liability:

5.1.3.1 Buy N Go Pickup's liability is limited to the amount paid for the transaction giving rise to the claim.

5.1.3.2 In no event shall Buy N Go Pickup be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage.

5.1.3.4 Some jurisdictions do not allow the exclusion or limitation of certain warranties or consequential damages, so some of the above limitations may not apply to you.

6. Privacy & Communications Policy (Opt-Out)

6.1 At Buy N Go Pickup and Delivery LLC, we value your privacy. This policy explains how we handle your personal information and your rights to opt out of communications.

Zero-Sharing Promise

i. We strictly use your personal data (Name, Address, Phone Number, Payment Info) solely for the purpose of facilitating your delivery.

ii. DO NOT sell, rent, or trade your personal information to third parties, marketers, or data brokers.

6.1.2. We DO share necessary details (Pickup/Drop-off address, First Name) with your assigned Independent Contractor Driver only for the duration of the active job.

6.2 Communications Policy (Calls & Texts)

6.2.1 By using the Buy N Go app, you consent to receive communications from us regarding your active orders.

6.2.2 Transactional Messages (Allowed): You will receive texts/calls regarding driver status, arrival times, and payment receipts. These are necessary for the service.

6.2.3 Marketing Messages (Optional): Occasionally, we may send promo codes or announcements. You have the absolute right to opt out of these.

6.3 How to Opt-Out (Your Rights)

If you wish to stop receiving non-essential communications, you may use the following methods:

6.3.1 Text Messages: Reply "STOP" to any text message you receive from us to be instantly unsubscribed from SMS alerts.

6.3.2 Email: Click the "Unsubscribe" link at the bottom of any marketing email.

6.3.3 Phone Calls: Ask our support team to place your number on our internal "Do Not Call" list.

6.4 Federal Privacy Resources

6.4.1 We fully comply with the Telephone Consumer Protection Act (TCPA) and federal privacy guidelines. If you wish to restrict telemarketing calls from all businesses, we recommend registering your number with the federal government:

7. GOVERNING LAW AND JURISDICTION

7.1 This Agreement shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law provisions.

7.2 You expressly consent to the exclusive jurisdiction of the courts located in Florida for any legal proceedings arising out of or relating to this Agreement or your use of the Platform.

8.1 By clicking "Accept" or creating an account, you confirm your understanding and agreement to all terms of the full Terms & Conditions. You acknowledge that you have read and understood this Agreement and agree to be bound by its terms and conditions.
