BUY N GO PICKUP DELIVERY SERVICES LLC CUSTOMER TERMS & CONDITIONS
1. GENERAL PROVISIONS
1.1 Agreement: These Terms & Conditions ("Agreement") constitute a legally binding contract between Buy N Go Pickup and Delivery Services LLC, a corporation organized under the laws of the State of Florida ("Buy N Go Pickup," "we," "our," or "us") and you, the user of the Buy N Go Pickup Platform ("Customer," "you," or "your").
1.2 Acceptance: By accessing or using the Buy N Go Pickup mobile application, website, or any related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy, which is incorporated herein by reference.
1.3 Modifications: Buy N Go Pickup and Delivery reserves the right to modify this Agreement at any time by posting an updated version on the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Agreement. It is your responsibility to review this Agreement periodically.
1.4 Eligibility: You must be at least 18 years of age and capable of forming a legally binding contract to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.
2. PLATFORM SERVICES​

2.1 Service Description: Buy N Go Pickup provides a technology platform that connects Customers with independent third-party service providers ("Drivers") who offer pickup and delivery services for bulky items. Buy N Go Pickup does not provide transportation or delivery services itself.
​2.2 No Guarantee of Service: Buy N Go Pickup does not guarantee the availability of Drivers or the successful completion of any requested delivery. The availability of service may vary based on location, time, and other factors.
​2.3 Service Limitations: Buy N Go Pickup reserves the right to refuse service, terminate accounts, or cancel delivery service at its sole discretion, including but not limited to situations involving violation of this Agreement, suspected fraudulent activity, items that violate our prohibited items policy, unreasonable behavior toward Drivers or Buy N Go Pickup personnel, or any other circumstances that Buy N Go Pickup determines warrant refusal of service.
3. USER ACCOUNTS

3.1 Account Creation and Security: You must create an account to use the Platform. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify Buy N Go Pickup of any unauthorized use of your account or any other security breach. Buy N Go Pickup reserves the right to suspend or terminate your account if we suspect unauthorized or fraudulent activity.
​3.2 Account Verification: Buy N Go Pickup may require verification of your identity or payment information before allowing you to use the Platform. You authorize Buy N Go Pickup to make inquiries and obtain information about you from third-party sources to verify your identity or payment information. Failure to provide accurate verification information may result in suspension or termination of your account.
4. PAYMENTS AND FEES​

4.1 Pricing and Payment: You agree to pay all fees associated with the services you request through the Platform, including delivery fees, service fees, and any applicable taxes. Prices for services may vary based on factors including distance, time, demand, and other considerations. Buy N Go Pickup reserves the right to implement dynamic pricing, which may increase or decrease fees based on local demand and other factors. All payments are processed through third-party payment processors, and you agree to comply with their terms and conditions.
​4.2 Payment Authorization: By providing payment information, you authorize Buy N Go Pickup to charge the designated payment method for all fees incurred. You represent and warrant that you have the legal right to use any payment method you provide. Buy N Go Pickup may pre-authorize your payment method for the estimated cost of services.
4.3 Cancellations and Refunds: Cancellation policies and any associated fees will be disclosed at the time of booking. Buy N Go Pickup reserves the right to charge a cancellation fee for cancellations made after a Driver has been assigned or has begun fulfilling your request. Refunds, if applicable, will be processed to the original payment method and may take up to ten business days to appear on your statement.
5. PROHIBITED ITEMS AND CONDUCT​

5.1 Prohibited Items: You agree not to request transportation of illegal substances, controlled substances, or drug paraphernalia; weapons, ammunition, explosives, or components thereof; hazardous materials, toxic substances, or flammable items; human remains or body parts; live animals; stolen property or counterfeit goods; items that require refrigeration or temperature control; items exceeding weight or size limitations as specified on the Platform; or any other items prohibited by applicable law or Buy N Go Pickup policy.​
5.2 Prohibited Conduct: You agree not to use the Platform for any illegal purpose; harass, threaten, or otherwise mistreat Drivers or Buy N Go Pickup personnel; provide false or misleading information about items to be transported; attempt to defraud Buy N Go Pickup or Drivers; use the Platform in any manner that could damage, disable, overburden, or impair it; attempt to gain unauthorized access to the Platform or related systems; use the Platform to collect or store personal information about other users; or engage in any activity that would violate the rights of Buy N Go Pickup, other users, or third parties.
6. DOCUMENTATION RETENTION AND PRIVACY​

6.1 Documentation Retention: Buy N Go Pickup's privacy policies and procedures are documented and maintained for at least six years from the date of creation or the date when last in effect, whichever is later. Policies and procedures are updated as necessary and appropriate to comply with changes in law, standards, requirements, and implementation specifications. Changes to policies and procedures are promptly documented, and when a change in law impacts a privacy notice, the notice is promptly revised and made available to necessary parties. Buy N Go Pickup maintains documentation of certain events and actions, including authorizations, requests for information, sanctions, and complaints relating to individual's privacy rights. All documentation, policies, procedures, actions, and activities are maintained in either written or electronic form.
​6.2 Privacy Policy: Buy N Go Pickup's collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into this Agreement by reference. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy. You acknowledge that Buy N Go Pickup may share your personal information with Drivers, third-party service providers, and others as necessary to provide the services and operate the Platform.
7. INTELLECTUAL PROPERTY​

7.1 Ownership: The Platform, including all content, features, and functionality, is owned by Buy N Go Pickup and its licensors and is protected by copyright, trademark, and other intellectual property laws. Buy N Go Pickup grants you a limited, non-exclusive, non-transferable, revocable license to use the Platform solely for the purpose of accessing and using the services offered through the Platform.
7.2 Restrictions: You shall not copy, modify, distribute, sell, or lease any part of the Platform or its content. You shall not reverse engineer or attempt to extract the source code of the Platform. You shall not remove, alter, or obscure any copyright, trademark, or other proprietary notices.
8. LIMITATION OF LIABILITY​

8.1 Disclaimer of Warranties: The Platform and all services are provided "as is" and "as available," without warranty of any kind, either express or implied. Buy N Go Pickup expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Buy N Go Pickup does not warrant that the Platform will be uninterrupted, timely, secure, or error-free.​
8.2 Limitation of Liability: In no event shall Buy N Go Pickup be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage. Buy N Go Pickup's total liability to you for all claims arising from or related to this Agreement shall not exceed the amount paid by you to Buy N Go Pickup for the services giving rise to the claim. These limitations apply to any theory of liability, whether based on warranty, contract, tort, negligence, strict liability, or any other legal theory.
9. INDEMNIFICATION​

9.1 You agree to defend, indemnify, and hold harmless Buy N Go Pickup, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform; your violation of this Agreement; your violation of any third-party right, including any intellectual property right or privacy right; any content or items you submit through the Platform; your interactions with any Driver or other user; or any damage you cause to property or any injury to persons.​
DISPUTE RESOLUTION​​

9.2 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You expressly consent to the exclusive jurisdiction of the courts located in the State of Florida for any legal proceedings arising out of or relating to this Agreement or your use of the Platform.​
​9.3 Arbitration: Any dispute arising from or relating to this Agreement or the Platform shall be resolved exclusively through final and binding arbitration in the State of Florida. The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association. You and Buy N Go Pickup agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.​

The liability of Buy N Go Pickup and Delivery LLC for loss or damage to items is strictly limited to the lesser of the actual invoice value of the damaged item(s) OR the sum of Fifty U.S. Cents ($0.50) per pound, not to exceed an aggregate maximum of Five Hundred U.S. Dollars ($500.00) per shipment.​

Actionable Advice for Customers:
If your item's replacement value is greater than $500.00, you should purchase supplemental insurance, as our maximum liability will not exceed that amount.
